REFERRAL
OPERATING PROCEDURE
This
procedure shall become effective June 1, 2008
Registrants
who are on the "Available for Work List" at the time
of implementation shall retain their position on the appropriate
lists so long as they continue to remain current under the new
procedure. Resign dates established under the previous system
shall still be applicable and enforceable.
Section
1 - Registration/Re-Registration
1.
Applicants for employment within the IBEW, Local 86 referral system
must
make
original
registration, in person, at the Local 86 Referral Office
between
the hours of 8:00 a.m. and 4:30 p.m. on normal business days (Monday
through
Friday except holidays), using the registration form supplied
by the
Local Union for that purpose.
2. Applicants shall
be assigned to the highest priority group for which they
qualify within the appropriate classification(s) and placed on
the
appropriate lists(s) in chronological order determined by the
date and
time of original registration.
3. Applicants who wish
to be considered for "specialty" calls (i.e. welding,
instrumentation, etc.) MUST register their
specialties with the referral
agent. Anyone not registered shall not be considered for
such calls.
Proof of qualification for a specialty will be required.
4. Registration on
the out-of-work lists shall only be valid for thirty (30)
days. In order to maintain their position on the referral
lists, applicants
must re-register and confirm their availability for employment
every
thirty (30) days or less. Re-registration (re-sign) may
be accomplished
in person at the Local 86 Referral Office between 8:00 a.m. and
4:30
p.m. on normal business days or by US mail, fax or e-mail (as
described
in items 5, 6 and 7 below). The thirty (30) day re-registration
deadline
shall be determined by the most recent previous registration.
Failure to
re-register during this period shall cause removal from the "List(s)"
at
the start of business on the thirty-first (31st) day. Applicants
sub-
mitting untimely re-signs via US Mail, fax or email will be notified
of
their removal. If removed, an applicant's original list
position shall be
forfeited and a new, original, in-person registration will be
required to
once again be considered an applicant for employment.
5. Applicants for employment
who wish to re-sign via US Mail must
complete and submit the Mail/Fax Re-Registration Form supplied
by
the Local 86 Referral
Office. In order to be considered
a valid
re-sign, this form must be RECEIVED by the Local
86 Referral Office
on or before the thirtieth day following the applicant's most
recent
previous registration date. Only the form supplied by Local
86
(or a copy thereof) will be accepted. Forms will be supplied
at the
time of original registration. New registrations must
always be made in
person.
6.
Applicants for employment who wish to re-sign by fax must
complete
and submit the Mail/Fax Re-Registration Form supplied
by the Local
86 Referral.
In order to be considered a valid re-sign, the fax must
be RECEIVED by the Local 86 Referral Office prior to 4:30 p.m.
(Rochester time) on the Thirtieth day following the applicant's
most
recent previous registration date. Only the form supplied
by Local 86
(or a copy thereof) will be accepted. Forms will be supplied
at the time
of original registration. New registrations must always
be made in
person.
7.
Applicants for employment who wish to re-sign via e-mail must
do so
through the IBEW, Local 86 website: www.ibewlu86.org.
The re-sign
form may be accessed through the Resign link on the homepage.
The
form must be completed in its entirety and submitted no later
than 4:30
p.m. (Rochester time) on the thirtieth day following the applicant's
most
recent previous registration date in order to be considered a
valid
re-sign. New registrations must always be made in person.
8.
Applicants' names will be removed from the referral list when
they
accept a job assignment through this referral system or become
employed by a signatory contractor within the jurisdiction of
IBEW,
Local 86 in any capacity.
9. Applicants who become
employed: 1) outside of the geographical
jurisdiction of Local 86; 2) within the geographical jurisdiction
of Local
86 by other than a signatory employer; or 3) by a signatory employer
within the geographical jurisdiction of Local 86 in other than
a Bargaining
Unit position, shall notify the Local 86 referral office.
Section
2 - Dispatch/Job Assignments
1. Normal dispatch
hours shall be between the hours of 8:00 a.m. and
10:00 a.m. on regular business dyas. Applicants for employemnt
shall
be responsible to make themselves available for job assignments
during
these hours.
2. It is the Business
Manager's responsibility to fill employer man-power
requests in a timely fashion. Therefore, in an emergency,
calls may be
filled outside of normal dispatch hours by whatever means necessary
to
meet this obligation. When calls are made outside of
normal dispatch
hours, a refusal will not be assessed for a non-response.
3.
When there are employer manpower requests to be filled,
the referral
agent will contact applicants registered on the "Available
for Work List"
by phone between 8:00 a.m. and 10:00 a.m. daily. The calls
will be made
in chronological order based on original registration date
by priority
group number, and will be made to the phone number listed on the
Referral Registration Form filed by the applicant.
Should an applicant's
phone number be changed, it is the applicant's responsibility
to notify
the referral agent of said change, in writing.
Section
3 - Referral "Call-Outs" and Dispatch
Normal
dispatch hours shall be between the hours of 9:00 a.m. and
12:00 noon on regular business days. Dispatch may occur
on weekends
and/or
holidays as necessary.
Duly
registered applicants for employment may apply for Journeyman
Wireman
job
assignments using the following procedure:
1. A list of available
job assignments may be obtained by calling the
referral office voice-mail system at (585) 235-1510 ext. 2 or
1-(800) 356-7090 from 5:00 p.m. on normal business days until
900 a.m.
(Rochester time) of the next business day. From time to
time, referral
calls must be filled on weekends and/or holidays to allow for
Sunday or
Monday work starts. It is therefore not advisable for applicants
to wait
until Sunday or Monday to check for weekend job availability.
2. Applicants who are
interested in accepting one or more of the listed
employment opportunities MUST get registered
on the daily checkk-in
list by calling the referral office voicemail system at (585)
235-1510
ext. 2 or 1-(800) 356-7090 from 5:00 p.m. on normal business days
until
9:00 a.m. (Rochester time) of the next business day and leaving
the
information listed in Step 3 of this Section on the recorder.
3. Registration on
the daily check-in list requires the following information:
1) appllicants name and card #; 2) what job or jobs the applicant
would
be willing to accept in order of preference; and 3) a phone number
where the applicant can be reached or a message may be left between
the hours of 9:00 a.m. and 12:00 noon.
4. The referral agent
will begin contacting applicants registered on the
daily check-in list for job referral assignments at some time
after 9:00
a.m. in chronological order of original registration by priority
group.
Calls will be made only to phone number registered on the daily
check-in
list.
5. If there is no response
at the registered number within a reasonable
time, the referral agent will proceed to the next person on the
list until
all calls are filled.
6. If there is no response
from the applicant at the registered number and
a voice message may be left, the referral agent will indicate
to what job
the applicant has been assigned (based on his/her position on
the "list")
and when and where he/she is to report. This message shall
be
considered a job assignment and the registrant is responsible
to man
the job at the designated date and time.
7. If the registered
number is a beeper, the referral agent will consider
the call unanswered and the applicant shall receive a refusal
if there is
no response from the applicant within thirty (30) minutes of the
time the
beeper message is left.
8. Job assignment calls
may be recorded on a random basis as part of
Local 86's record keeping system.
9. Due to the Business
Manager's responsibility to fill employer man-power
calls in a timely fashion, emergency calls and open calls not
filled by the
phone-in procedure which cannot wait another day due to employer
needs (as determined by the Business Manager through the referral
agent) will be filled using the "traditional" method
of calling applicants
from the referral list in chronological order by priority group.
Due to
the very nature of emergency calls, applicants from the referral
list
cannot be contacted within a reasonable period of time (as determined
by the Business Manager through the referral agent) will be skipped
over and the referral agent will proceed to the next person on
the list
in an attempt to fill the job(s).
10. Referral slips must be
picked up at the Local 86 busines office prior to
reporting for a job assignment unless otherwise instructed by
the referral
agent. Upon an employer's refusal to hire or termination
of employment,
referral slips must
be completed and signed by the employer or a
representative thereof
and returned to the referral office. Properly
completed and signed
referral slips shall be required proof of 1) employer
refusals; and/or 2)
employment duration for the purpose of list reinstate-
ment under Section
1, Step 10 of this Referral Procedure.
Section
4 - "Refusals" (The Ding System)
1. Any registrant receiving
a third turndown (refusal/ding system) will be
removed from the applicable "List(s)" (not rolled to
the bottom). If
removed, the applicant's original list position shall be forfeited
and a
new, original, in-person registration will be required to once
again be
considered an applicant for employment.
2. Registrants will
be assessed a refusal when:
A. a job assignment is offered by the Business Manager,
referral
agent or designee and cannot be filled with Book 1 registrants
B. they cannot be reached during normal dispatch hours to
respond
to a job
C. applicant for employment does not possess the required
safety
training (i.e. Kodak card, 10 Hr. OSHA card etc.) in order to
tmely
accept the job assignment
3. Referral applicants
properly registered and current on any Local Union
86, IBEW out-of-work lists(s) who are working out-of-town under
an IBEW
Collective Bargaining Agreement shall be eligible and have the
option to freeze
their dings on the out-of-work list(s) and not be eligible for
future job
assignments.
Applicants so frozen, who remain current through re-signs will
be returned to the
normal referral process upon termination of approved out-of-town
employment or
their request to do so being properly received by the referral
office in writing.
Applicants who are not working under an IBEW Collective Bargaining
Agreement
are not eligible for this option. Verification of employment
will be required by
way of a form signed by the business manager or designee of the
local in which
the work is being performed, or a pay stub, monthly with resign.
If an available job(s) cannot be filled by non-frozen applicants
from the highest
priority group, applicants on Book II will be called.
In order to maintain frozen status, applicants must re-register
(re-sign) through
the normal referral process every 30 days or less. Applicants
not so re-signed,
will be REMOVED from the list(s).
Once unemployed, frozen applicants are obligated to notify the
referral office
and return to the normal referral process. Anyone found
to be unemployed and
applying for or maintaining frozen status will be removed from
the out-of-work
list and must report in person to sign Book I and be placed at
the back of the
out-of-work list. Additionally, the member shall Not
be eligible for this option
for 12 months.
An Applicant must give the Union Hall 24 hour's written
notice to unfreeze
his/her number on the book. Once notice has been received,
the applicant will
eligible to take "job calls" 24 hours later. Change
request left on a voicemail
message will NOT be considered.
Section
5 - Exceptions to a Refusal
1. Any applicant serving
in the military
2. Any applicant working
full time for the JATC as a teacher
Section
6 - Out of Town Resigns
All applicants wishing to resign
out-of-town books through the referral office must
request
resigns "24 hours" before resign is due. Please
have all proper forms, dates, current dues receipts available
for said resigns.
"Once
an applicant qualifies for, requests and is granted Group I status
in any local union, he shall retain that status in the local union
and shall not be required to requalify unless he qualifies for,
requests and is granted Group I status in another local union.
If that situation occurs, the applicant would have to requalify
for Group I status in any previous local union(s) in which he
enjoyed Group I status."
