REFERRAL
OPERATING PROCEDURE
This
procedure shall become effective June 1, 2012
Registrants
who are on the “Available for Work List” at the time of implementation
shall retain their position on the appropriate lists so long as
they continue to remain current under the new procedure.
Section
1 – Registration/Re-Registration
1.
Applicants for employment within the IBEW, Local 86 referral
system must make original registration, in person, at the Local
86 Referral Office between the hours of 8:00 a.m. and 4:30 p.m.
on normal business days (Monday through Friday except holidays)
, using the registration form supplied by the Local Union
for that purpose.
2.
Applicants shall be assigned to the highest priority group
for which they qualify within the appropriate classification(s)
and placed on the appropriate list(s) in chronological order determined
by the date and time of original registration.
3.
Applicants who wish to be considered for “specialty” calls
(i.e. welding, instrumentation, etc.) MUST
register their specialties with the referral agent. Anyone not
registered shall not be considered for such calls. Proof of qualification
for a specialty will be required.
4.
Registration on the out-of-work list(s) shall only be valid
for one (1) month. In order to maintain their position on the
referral list(s), applicants must re-register and confirm their
availability for employment from the 10 th through the 16
th of each month . Re-registration (re-sign) may be accomplished
in person at the Local 86 Referral Office between 8:00 a.m. and
4:30 p.m. on normal business days, by US Mail, fax or e-mail (as
described in item 5). Failure to re-register from the 10
th through the 16 th of each month shall cause removal from the
“List(s)” at the start of the next business day. If removed,
an applicant’s original list position shall be forfeited and a
new, original, in-person registration will be required to once
again be considered an applicant for employment.
5.
Applicants for employment who wish to re-sign via mail
or fax must complete and submit the Mail/Fax Re-Registration
Form supplied by the Local 86 Referral Office. Applicants
for employment may also re-sign via e-mail by going to the IBEW,
Local 86 website at www.ibewlu86.org
. The re-sign
form may be accessed through the Resign
link on the homepage. In order to be considered a valid re-sign,
one of these forms must be RECEIVED
by the Local 86 Referral Office from the 10 th through the 16
th of each month by 4:30 p.m. Only the form supplied by Local
86 (or a copy thereof) will be accepted. Forms will be supplied
at the time of original registration. New registrations must
always be made in person.
6.
Applicants’ names will be removed from the referral list
when they accept a job assignment through this referral system
or become employed by a signatory contractor within the jurisdiction
of IBEW, Local 86 in any capacity.
7.
Applicants who become employed: 1) outside of the geographical
jurisdiction of Local 86; 2) within the geographical jurisdiction
of Local 86 by other than a signatory employer; or 3) by a signatory
employer within the geographical jurisdiction of Local 86 in other
than a Bargaining Unit position, MUST notify the Local 86 referral
office.
Section
2 – Dispatch/Job Assignments
1.
Normal dispatch hours shall be between the hours of 9:00
a.m. and 12:00 p.m. on regular business days. Applicants for employment
shall be responsible to make themselves available for job assignments
during these hours.
2.
It is the Business Manager’s responsibility to fill employer
man-power requests in a timely fashion. Therefore, in an emergency,
calls may be filled outside of normal dispatch hours by whatever
means necessary to meet this obligation. When calls are made
outside of normal dispatch hours, a refusal will not be assessed
for a non-response.
Section
3 – Referral “Call-Outs” and Dispatch
Normal
dispatch hours shall be between the hours of 9:00 a.m. and 12:00
p.m. on regular business days. Dispatch may occur on weekends and/or
holidays as necessary.
Duly
registered applicants for employment may apply for job assignments
using the following procedure:
1.
A list of available job assignments may be obtained by
a.) calling the referral office voicemail system at (585) 235-1510
ext. 2 or (800) 356-7090 or b.) by going to www.ibewlu86.org
and clicking
on the Web Referral tab from 5:00 p.m. on normal
business days until 9:00 a.m. (Eastern time) of the next business
day.
2.
Applicants who are interested in accepting one or more
of the listed employment opportunities MUST
get registered on the daily check-in list(s) by calling the referral
office voicemail system at (585) 235-1510 ext. 2 or (800) 356-7090
or by going to www.ibewlu86.org
and clicking
on the Web Referral tab from 5:00 p.m. on normal
business days until 9:00 a.m. (Eastern time) of the next business
day and leaving the information listed in Step 3 of this Section.
3.
Registration on the daily check-in list(s) requires the
following information: 1) applicants name and card number; 2)
what job or jobs the applicant would be willing to accept in order
of preference; and 3) a phone number where the applicant can be
reached or a message may be left between the hours of 9:00 a.m.
and 12:00 p.m.
4.
The referral agent will begin contacting applicants registered
on the daily check-in list(s) for job referral assignments after
9:00 a.m. in chronological order of the original registration
by priority group. Calls will be made only to the phone number
registered on the daily check-in list(s) or registration referral
form.
5.
If there is no response from the registered number by 12:00
p.m., the referral agent will proceed to the next person on the
list until all calls are filled according to Step 7 of this Section.
6.
Job assignment calls may be recorded on a random basis
as part of Local 86’s record keeping system.
7.
Due to the Business Manager’s responsibility to fill employer
man-power calls in a timely fashion, emergency calls and open
calls not filled by the phone-in procedure which cannot wait another
day due to employer needs (as determined by the Business Manager
through the referral agent) will be filled using the “traditional”
method of “calling” applicants from the referral list in chronological
order by priority group. Due to the very nature of emergency calls,
applicants from the referral list who cannot be contacted within
a reasonable period of time (as determined by the Business Manager
through the referral agent) will be skipped over and the referral
agent will proceed to the next person on the list in an attempt
to fill the job(s).
8.
Referral slips must be picked up at the Local 86 business
office prior to reporting for a job assignment unless otherwise
instructed by the referral agent. Upon an employer’s refusal
to hire, a member shall report back to the union hall, resign
the book, and shall be returned to previous position.
Section
4 – “Refusals” (The Ding System)
1.
Any registrant receiving a third turndown (refusal/ding
system) will be removed from the applicable “List(s)” ( not
rolled to the bottom ). If removed, the applicant’s
original list position shall be forfeited and a new, original,
in-person registration will be required to once again be considered
an applicant for employment.
2.
Registrants will be assessed a refusal when:
a.
A job assignment is offered by the Business Manager, referral
agent or designee and refused;
b. If
they do not respond during normal dispatch hours for a job call.
If
an available job(s) cannot be filled by applicants from the highest
priority group, applicants on Book II will be called.
Section
5 – Exceptions to a Refusal
1.
Any applicant serving in the military.
2.
Any applicant working full time for the JATC as a teacher.
3.
Any applicant on the Sick List.
4.
Any applicant working out of town under a Collective Bargaining
Agreement.
a.
Verification of employment will be required by way of
a form signed by the Business Manager or designee of the local
in which the work is being performed, or a pay stub, monthly
with resign. In order to maintain this status, applicants must
re-register (re-sign) through the normal referral process.
b.
An Applicant must give the Union Hall 24 hour’s written
notice to activate his/her number on the book.
Once notice has been received, the applicant will be eligible
to take “job calls” 24 hours later. Change request left on a
voice mail message will NOT be considered.
c.
Once applicant becomes unemployed out of the jurisdiction
they are obligated to notify the referral office and must return
to the normal referral process. Anyone found to be unemployed
and applying for this status will be removed from the out of
work list(s) and must sign the book in person.
5.
Salting with a signed Salt Agreement.
6.
One time vacation (per calendar year ~ January 1 st – December
31 st ) with confirmation of approval in writing.
Section
6 – Out of Town Resigns
Local
86 does not fax re-signs unless “required” by
Local Union Halls to be on letterhead. If you have a re-sign that
must be faxed by the hall, you need to call the day before it needs
to be sent. *** According to the International all Book
II resigns must be done from the 10 th through the 16 th of each
month.
“Once
an applicant qualifies for, requests and is granted Group I status
in any local union, he shall retain that status in the local union
and shall not be required to re-qualify unless he qualifies for,
requests and is granted Group I status in another local union. If
that situation occurs, the applicant would have to re-qualify for
Group I status in any previous local union(s) in which he enjoyed
Group I status.”
